Penguin won't be in TDK?

For you Penguin lovers, you might disappointed to hear this when Christopher Nolan asked about the casting of Phillip Seymour Hoffman as the Penguin:

"Not true. I'd be more excited to have Philip Seymour Hoffman in the film than to have the Penguin. There are certain characters that are easier to mesh with the more real take on Batman we're doing. The Penguin would be tricky."

While I don't mind Penguin won't be in TDK, I surprised that Chris Nolan doesn't know that Penguin is a lot more real than the Joker. I think he refers to Batman Returns' Penguin as his source. He should ask David Goyer for advice.
